Terms of sale

A - Introduction

These general terms and conditions (hereinafter abbreviated to “General Conditions”) apply to the sale of products by the seller www.caminivecchioenuovo.it (hereinafter: Vecchio e Nuovo). All contracts for the sale of goods between buyer and seller entered into via the website www.caminivecchioenuovo.it in accordance with the procedures specified therein are governed by these General Conditions.

B - Acceptance of the general terms and conditions

1. The contract entered into between Vecchio e Nuovo and the Customer shall take effect upon, even partial, acceptance of the order by Vecchio e Nuovo that reserves the right to accept the order at its absolute discretion. Tacit acceptance may be implied unless the Customer is notified to the contrary. By placing an order in the various ways described, the Customer confirms having taken note of all information provided whilst purchasing and complete acceptance of the general conditions and payment methods specified hereafter.
2. The Customer shall have no entitlement to compensation for damages and there shall be no contractual or non-contractual liability for immediate or consequential bodily injury and/or damage to property arising from, even partial, non-acceptance of an order.

C - Method of purchase

1. The customer may only purchase products listed in the Vecchio e Nuovo electronic catalogue when submitting the order, these can be seen at the website www.caminivecchioenuovo.it along with an accompanying description.
2. Vecchio e Nuovo will acknowledge receipt of the order by e-mail to the address that the Customer has supplied. The message mirrors the information provided by the Customer who is asked to check that the details are correct and promptly submit any corrections needed in the manner described herein.
3. If the order cannot be accepted, Vecchio e Nuovo undertakes to advise the Customer promptly in the same manner.
4. All prices shown on the website are intended as the consumer price excluding VAT. Vecchio e Nuovo reserves the right to alter prices at any time without prior notice.

D - Method of payment

Vecchio e Nuovo accepts the following methods of payment:

1. Bank transfer to the account specified when ordering. The reason for payment should always quote the customer’s full name and the order number given in the e-mail s/he received after placing the order.

E - Delivery methods and charges

1. Delivery of the goods will take place as a shipment organised by Vecchio e Nuovo or else the Customer may arrange to collect in person. The choice between the two options is decided by the Customer when placing the order.
2. For each separate order placed at www.caminivecchioenuovo.it Vecchio e Nuovo will issue an invoice for the material purchased. The invoice details will rely on the information provided by the Customer when ordering.
3. Shipping and delivery charges payable by the Customer are clearly shown when the order is placed.
4. Shipment or collection of the products purchased will only take place after Vecchio e Nuovo has received full payment of the amount due. Upon receipt of payment, goods are usually shipped within 3 working days; this may change due to force majeure, general road and traffic conditions or measures taken by the public authorities.
5. Vecchio e Nuovo shall not be liable for any delay in processing the order or delivering the goods ordered.
6. Should a delivery contain damaged, incorrect or missing items, the delivery driver should be notified immediately. Similarly, our staff should be notified immediately when collecting for from our shop in person. Any hidden defects should be notified in writing by fax or recorded delivery within two days of receiving the order. No claim shall be entertained unless notified within the specified time. The customer takes full responsibility for the content of any report submitted.

F - Right to cancel

1. Under the terms of distance selling regulations covered by Legislative Decree 185/99, the Customer may cancel the purchase of the goods/services received within 10 working days of the delivery date or signing of the contract in the case of provision of services.
2. To cancel a contract you must notify us in writing of your desire to do so by recorded delivery. Address your letter to: Vecchio e Nuovo di Lauro Giuseppe - Via Liancourt 14 , 22070 Olgiate Comasco (CO). You may also fax the notice of cancellation by the deadline to (+39) 031 940720 subject to sending confirmation by recorded delivery within the following 48 hours.
3. When exercising the right to cancel, the Customer shall also return the goods in their original condition at his/her own expense to: Vecchio e Nuovo di Lauro Giuseppe - Via Liancourt 14 , 22070 Olgiate Comasco (CO).
4. Provided s/he has exercised the right to cancel in accordance with these instructions, Vecchio e Nuovo will arrange to refund the Customer the purchase price less delivery charges within no more than 30 days of receiving the request.
